Use of our website is deemed acceptance of our terms and conditions, policies and guidelines. Please note that this is a privately owned, independent website and is not affiliated with Invision Power Services, its website or its operators or owners in any way.

 

PRODUCT AVAILABILITY

We reserve the right to amend, remove, replace or discontinue products and services. Sales are only available and supported within the US, Canada, Europe inc EU, Australia, New Zealand area.

During Checkout

As part of the checkout process, you can choose from the available payment method options. As part of the payment process, the payment provider will conduct relevant checks to reduce and prevent payment transaction fraud and misuse at their discretion. If your checkout is unsuccessful, please consult your bank or card provider in the first instance, then the payment service provider i.e. Stripe, PayPal etc. We reserve the right to refuse, manually approve or withdrawal the offer of products or services if there are repeated payment transaction problems or concerns. Your statutory rights are not effected.

 

Custom Work & Services

Estimates and prices quoted remain strictly confidential and are valid for 30 days. We reserve the right to charge for requested additional or supplementary work once completed. 

 

After a Purchase

Following a successful purchase and registration on our website, your account will have been upgraded to Client status. You can find, manage and download your purchases at any time from your Client area and Downloads area. You will also have access to our client support ticket system and to our exclusive client forums. If you decide not to renew at least one product with an annual renewal, your account will be downgraded to a standard membership (non-client) access level.
 

Product Compatibility

Only for use with IPS Invision Community

Unless clearly stated otherwise, our products are only compatible with Invision Community (aka IPS) from Invision Power Services (IPS, Inc). They WILL NOT work on or with other software such as Wordpress, Xenforo, VBulletin etc. The products on this website are only compatible with official IPS addons prior to modification, unless cleary stated otherwise.

Our products are maintained to be compatible with the latest and currently supported versions of the Invision Community platform, therefore you may need to perform or arrange a software update of your Invision Community installation prior to purchase or install, if it becomes outdated.

Please allow reasonable time whilst we update our products for compatibility with new releases of IPS. We will endeavour to do this as soon as possible.

There is no guarantee or assurance that our themes or products will work 100% with all or specific third party modifications by default, however themes can be adjusted to ensure 3rd party addons function correctly if required. Fees may apply.

Before purchasing any of our themes and products, please ensure that you are definitely using Invision Community and that the theme or product you are purchasing is compatible with the version of your community suite. We state this clearly on our site. 

We currently only officially sell our products here on our website. Never purchase or download a Invisionary Themes & Design product elsewhere without checking with us first.

We do not support end of life or depreciated products. Refunds cannot be provided for incorrect software compatibility.

Please contact us or use our pre-sales forum before purchasing if you have any doubts, concerns or would like further information.

 

Sales, Charges, Fees, Refunds, Disputes and Exchanges

Since the products on this website are digital items, refunds or exchanges are not offered once you have downloaded the product. All purchases and downloads are recorded. If the theme has not yet been downloaded, you are able to request a refund or exchange by contacting us.

Any attempts at payment disputes (after you have downloaded the product without first trying to come to a reasonable solution) without fair and valid reason may possibly be considered attempted theft, fraud or result in the cancellation of your customer account.

Fees including renewals for our products and services including themes, plugins or apps relate to compatibility with the current 'major branch' of the available IPS product range, for example IPS4 and all subsequent v4 releases, for example v4.7 etc.

Upon release of a major new product release such as for example a future V5 series, we reserve the right to create new compatible product ranges and charges will apply separately for those releases.

Sales Prices and End of Life Products

We reserve the right to offer our products and services as part of limited time sales offers, such as seasonal or special events such as Black Friday, Cyber Monday or Holiday sales, to reduce or increase prices, or to depreciate or end support for end of life products.

 

Copyright Removal / Modifications

You may modify the product you have purchased as much as you like to fit your own requirements, however you may only remove the footer copyright attribution text and link from a theme if our Copyright Removal is purchased.

 

File-sharing and Distribution

We do not tolerate fraud or theft. When purchasing and/or downloading any products from this site, you agree that you will not redistribute or resell your purchased item, or any part of the design (including but not limited to images, code, audio, video, xml and psd files) under any circumstance.

Distributing these files (eg. on file-sharing sites, nulled software or warez sites) is highly prohibited. If you are caught distributing any files created or sold by Invisionary.tech or if you buy an item on behalf of a warez site, your account will be banned without warning or refund, your personal details may be sent to Invision Power Services for review and we reserve the right to report the concern to law enforcement authorities.

You do not have permission to purchase any products from this website if you are actively involved in administrating or contributing to warez sites (including but not limited to posting, requesting or downloading items, donating or posting links to items originating from this site). Doing so will result in the immediate cancellation of your account without refund.

 

Images and Content

You agree not to copy or use images, media or content from our website without prior consent, unless for the purpose of education, social sharing and promotion. Our website contains certain content and images provided for use with written consent by third parties.

• Contain contact information ie phone numbers, postcodes etc
• Appear to impersonate someone else
• Contain swear words or are otherwise objectionable

We reserve the right to remove or edit messages, comments or other content at any time for lawful, editorial or commercial reasons or which:

• Are considered likely to disrupt, provoke, attack or offend others
• Are racist, sexist, homophobic, sexually explicit, abusive or otherwise objectionable
• Contain swear words or other language likely to offend
• Contain links to competitors.
• Break United Kingdom law or condone or encourage unlawful activity. This includes breach of copyright, defamation and contempt of court.
• Advertise products or services for profit or gain without consent
• Are seen to impersonate someone else
• Include contact details such as phone numbers, postal or email addresses
• Are written in anything other than English so that we may understand and assist
• Contain links to other websites which break our Guidelines
• Describe or encourage activities which could endanger the safety or well-being of others
• Are considered to be ‘spam’, that is undesirable content of poor quality, containing the same, or similar, message posted multiple times, or unsolicited advertising and promotion without consent
• May be considered to be off-topic for the website.

If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your accounts. Deliberate misuse of the reporting/complaints facility is not permitted. If you persist in doing this, action may be taken against your account.

 

Sensible Online Safety

We advise that in public community areas that you never reveal any personal information about yourself or anyone else (for example: telephone or mobile number, home address or email address), and please do not include postal addresses of any kind.

If you have a helpful address to share, inform the Administrator using the ‘Contact Us’ link, and they will promote it if they see fit.

The minimum age to register on this website is 18. 
 

Legal Compliance

• The views expressed on our website’s communal areas are those of members of the public and are not necessarily those of Invisionary.tech or its owner.

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

These terms shall be governed by and interpreted in accordance with the laws of England and Wales, UK.
